According to a statement by the American Institute for International Steel (AIIS), The US Court of International Trade has granted its request to have a three-judge panel evaluate the constitutionality of the US Section 232 statue used to impose tariffs on steel imports.
The suit was filed on July 27, 2018 by the AIIS and two of its member companies, SIM-TEX, LP, of Waller, Texas, and KURT ORBAN PARTNERS, LLC, of Burlingame, California. The lawsuit seeks a declaration that the law relied on by President Trump to impose that tariff is unconstitutional, as well as a court order preventing further enforcement of the 25% tariff increase. The AIIS complaint challenges the definition of “threat to national security” and the lack of provision for judicial review of the President’s decision in how his administrations responds to perceived threats from imported steel.
