EU amends definitive AD duty order on Vietnamese SS fasteners and parts

The European Union has amended the definitive antidumping duty order on imports of certain stainless steel fasteners and parts thereof originating, inter alia, in Vietnam, imposed on November 14, 2005.

A request for a partial interim review of the basic regulation was lodged by Header Plan Co. Ltd, a Vietnamese exporting producer of stainless steel fasteners. The request was limited in scope to dumping and to the applicant company. The applicant provided prima facie evidence that the continued application of the measure at its current level was no longer necessary to offset dumping.

Having determined, after consulting the Advisory Committee, that the request contained sufficient prima facie evidence, the European Commission (EC) announced on August 13, 2008 the initiation of a partial interim review. The review was limited in scope to the examination of dumping in respect of the applicant. The investigation of dumping covered the period from July 1, 2007 to June 30, 2008.

The product concerned by the present review is the same as that in the original investigation, that is to say certain stainless steel fasteners and parts thereof. It is currently classifiable within CN codes 7318 12 10, 7318 14 10, 7318 15 30, 7318 15 51, 7318 15 61 and 7318 15 70.

In view of the findings of no dumping as well as the lasting nature of the changed circumstances, it is considered that the continued imposition of the measure on imports from the applicant is not necessary to offset dumping. The measures imposed by the regulation on imports of certain stainless steel fasteners originating in Vietnam should therefore be repealed for Header Plan by amending the original regulation accordingly.

Therefore, the part of the table in the original regulation concerning the definitive antidumping duty applicable on imports of certain stainless steel fasteners and parts thereof originating in Vietnam shall be replaced by the following:
