As of May 15, the US Department of Commerce (DOC) will formally reinstate the antidumping (AD) duty order on hot rolled carbon steel flat products from Thai steelmaker Sahaviriya Steel Industries Public Co. Ltd. (SSI).
The DOC originally revoked the AD order against SSI in May 2006; however, SSI agreed to the reinstatement of the AD order if it was found to have resumed dumping.
In November 2008, US Steel Corp. claimed that SSI had resumed dumping, prompting the DOC to initiate this "changed circumstances" review. The DOC then made a preliminary determination that SSI had resumed dumping, and it instructed US Customs and Border Protection (CBP) to suspend liquidation of all entries of hot rolled carbon steel flat products from SSI, effective December 30, 2008. The DOC has now made a final determination that SSI resumed dumping during the period of review: July 1, 2006 through June 30, 2007.
Therefore, the DOC will instruct CBP to continue to suspend liquidation and to require a dumping deposit of 9.04 percent on all entries of subject merchandise from SSI.
